Terms of Service.

These Terms of Service ("Terms") govern your use of the Craft & Ship service ("Service") operated by Aaron Longnion ("Craft & Ship," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Craft & Ship builds custom websites for small businesses. You describe the website you want through our chat-based intake. We turn that description into a written specification (the "Spec"), you review and approve the Spec, and we then build your website from a curated library of pre-built, tested software building blocks and tailor it to your Spec.
A Senior Web Craftsman reviews every website before delivery. The typical end-to-end timeline from payment to review-ready preview is 1 to 2 business days. The resulting website is delivered to a live URL hosted on our cloud infrastructure (Railway).
We use artificial intelligence (powered by Anthropic's Claude) in specific parts of the Service: turning your chat description into a structured Spec, answering questions in the support chat, and assisting with ongoing monitoring and diagnostics. Except where clearly disclosed, the website build itself is assembled deterministically from our library of building blocks and does not rely on AI to generate your website's code.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@craftandship.io if you become aware of any unauthorized use of your account.
4. Payment Terms
Craft & Ship offers a paid monthly subscription for website creation and hosting. All prices are listed in US Dollars. Payment is processed through Stripe. By submitting payment, you authorize us to charge the applicable fees.
- Non-refundable after build starts. Once your build has been queued and processing begins, the build fee is non-refundable.
- Refund for failed builds. If we are unable to successfully build your website and cannot resolve the issue, you are entitled to a full refund of the build fee.
- Hosting fees. The one-time build fee includes the first 3 months of hosting and monitoring. Beginning month 4, monthly hosting fees are billed in advance at the tier rate shown on the pricing page. You may cancel hosting at any time; cancellation takes effect at the end of the current billing period. When hosting ends, your website remains yours under Section 5 (Ownership of Generated Code).
- Cancellation. You may cancel a build request at any time before it enters the build queue for a full refund. Once the build has been queued, cancellation is not available and the non-refundable policy above applies. To cancel hosting, contact support@craftandship.io; your website will remain live through the end of your current paid period.
- Disputes. If you believe a charge is incorrect, contact us at support@craftandship.io within 30 days of the charge. We will review the dispute and respond within 5 business days. If we cannot resolve the dispute, you may escalate through your payment provider.
- Promotional pricing. From time to time, we may offer promotional or beta pricing at reduced rates. Promotional prices are valid for the duration stated at the time of purchase and apply only to new builds placed during the promotional period. Standard pricing resumes when the promotion ends.
5. Ownership of Generated Code
You own the source code we deliver for your website. Upon successful delivery, all intellectual property rights in the website source code we provide to you are assigned to you. This does not include any underlying platform code, the library of pre-built building blocks, tools, third-party libraries, or infrastructure used to build or host the website. Open-source components remain under their respective licenses.
6. Our Right to Use Anonymized Data
We retain the right to use anonymized, aggregated data derived from your use of the Service (such as general patterns in website specifications, build metrics, and usage statistics) to improve and develop the Service. This data will not identify you or your specific website.
7. Acceptable Use
You agree not to use the Service to:
- Create websites that contain or distribute illegal content
- Build websites that infringe on the intellectual property rights of any third party
- Create websites designed for fraud, phishing, or deception
- Build websites that distribute malware or engage in unauthorized data collection
- Violate any applicable law or regulation
- Attempt to reverse-engineer, interfere with, or disrupt the Service
8. Your Responsibilities
You are solely responsible for the content, functionality, and legal compliance of the websites you create through the Service. This includes ensuring your website complies with all applicable laws, does not infringe third-party rights, and includes any required disclosures (such as privacy policies for your own users). Craft & Ship does not review your website for legal compliance.
9. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, including the Acceptable Use provisions. We may also terminate accounts that have been inactive for an extended period with prior notice via email. You may close your account at any time by contacting support@craftandship.io.
Upon termination, your right to use the Service ceases immediately. If your website is hosted on our infrastructure, we will provide 30 days notice before taking down the hosted website, except in cases of serious abuse or legal requirement.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee that websites delivered through the Service will be free of bugs or suitable for any particular purpose. While every website is reviewed by a Senior Web Craftsman before delivery, software may still contain errors, and you are responsible for reviewing and testing your website before relying on it in production.
Parts of the Service (including intake, support chat, and monitoring) use artificial intelligence. AI output may contain errors, omissions, or hallucinated information. Do not rely on AI-generated content for legal, medical, financial, or other professional advice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFT & SHIP'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO CRAFT & SHIP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL CRAFT & SHIP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless Craft & Ship, its owner, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or any website you create through the Service.
13. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Texas. The arbitrator's decision shall be final and binding.
Class action waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, not as a class action or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Small claims exception. Either party may bring an individual action in small claims court if the claim qualifies.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days advance notice via email to the address associated with your account. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before they take effect.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Craft & Ship regarding the Service and supersede all prior agreements and understandings.
